Things are changing fast. On October 21, 2026, the OCC announced its final rule implementing the GENIUS Act, with January 18, 2027 as the effective date. → Read the announcement.
Before you put your savings into a payment stablecoin, understand these four provisions in the law:
- Your tokens can be frozen. Issuers must be able to comply with lawful orders to freeze, seize, destroy, or block transfers of specified tokens. Sections 2(16) and 4(a)(6)(B).
- The issuer cannot pay you interest simply for holding the token. The prohibition covers interest or yield paid solely for holding, using, or retaining it. Section 4(a)(11).
- Your token has no federal deposit insurance. No FDIC coverage. No NCUA coverage. No U.S. government guarantee. Section 4(e)(1) and (2).
- Issuers must identify customers and monitor transactions. The law requires records, suspicious-transaction reporting, and capabilities to block prohibited transactions. Section 4(a)(5)(A)(ii) through (v).
These provisions are written into the GENIUS Act. A familiar dollar sign does not tell you who controls the token, or what protections you have.
